First port of call with this is with your breeder then the registered bodies TICA and GCCF

Also the above will only consider anything with the results of a necropsy done to the kitten/ cat - post mortom as other diseases can show the same high titre counts

I know I lost a Mum and 3 kittens to FIP and have the remaining kitten still with us she is a Corona carrier but was going nowhere - rescue cats sadly a brother and sister mating - I still have the Dad and he is clear

I wonder how your court case went ? as we are in a similar position now. I got two kittens three weeks ago one was put to sleep yesterday and the other will probably have to go tomorrow. They both have FIP.
Would be really grateful for any information on it,

I'm very sorry to hear you're facing such heartbreak. 

Again, I would make an approach to the GCCF or TICA, depending what the breeders affiliation is.  Have you had any contact with the breeder direct since this arose?

FIP is a terrible disease and i am so sorry you lost your cats to it.

Its a difficult one to control because the corona virus is very widespread and only causes problems in the cats that mutate it to FIP. So testing for corona would not be testing for FIP and as the carriers of the virus are healthy there is no way off assuming they are carriers. The other problem with testing is that if corona is present there is nothing you can do. FIP is unlikely to develop and if it does there is no effective treatment. No vaccination either.

Obviously is a different situation in rescue as opposed to breeding as we are never choosing to breed. I have no idea whether the  GCCF has recommendations for breeding with corona virus and how they would police this. The problem with a lot of breeding is there may well be guidelines on good practice - but not necessarily any enforcement.

Seashell is beauuuuutiful (like the name too!)

We are still waiting for conclusion of our case however I would be interested to know if anyone else has gone the route of small claims and with what success?.
Also more generally how big a problem is corona virus and what steps are being taken to reduce it?   Should mandatory testing be introduced for breeders?

I'm new to this forum and have just posted about losing my Harvey to FIP, I am positive that the coronavirus  came from the mother and was absolutely devastated last year at losing him, keep fighting.  I didn't pursue this because I was too upset at the time but wish I did now  :shocked:

Dear Everyone,
Case still to be heard but we hope to have the vet who examined kitten at court.Seashell is doing well now 2 and recently able to be spayed as she was negative for corona virus antibodies.

Good News Seashell had negative blood test for corona virus and we where able to have her spayed still waiting for outcome from small claims court.

Thanks for all your help have contacted GCCF who have a complaints procedure will await outcome before considering small claims court.Good news Seashell 2nd kitten has shown good results for corona virus levels that have come down considerably since she was first tested.

Martin and Katia - welcome to the forum.  I'm sorry that it's under such sad circumstances.

I think that certainly the first approach is to the Breed Council to establish if the breeder is a regulated licensed breeder.  I think I would also be drawing it to the attention of the RSPCA, because if the breeder is selling indiscriminately then it should be investigated.  Any reputable breeder will appreciate that.

In terms of monetary compensation (always an ugly subject, but pertinent, as pedigrees are never cheap to take on) you could commence a claim against the breeder under the Small Claims process in England and Wales (assuming the breeder's England/Wales based).  This applies to any claim with an overall monetary value less than £10,000.

It's relatively inexpensive - you pay an issue fee to the court based on the value of your overall loss (for example the cost of the two kittens, any transport costs paid, and any verifiable veterinarian costs) but you should be aware that even where you successfully obtain a Judgment, it may not be easy to obtain compensation from the breeder without having to take some form of enforcement action.

Whilst you can recover a degree of fixed costs for your outlays, it is a time consuming and often frustrating process.  If you instruct a solicitor to act on your behalf for example, you would not recover all of the expense that you would pay to a Solicitor, and could end up being out of pocket even where you technically "win" your claim.

The Small Claims Courts also offer a free medation service to its users, where once proceedings have been issued should a Defendant (what they call the person against whom the claim has been brought)) file a Dispute (called a "Defence") challenging the claim.  The Mediator is an independent, who will attempt to get the parties to address any areas of disagreement, and reach a legally binding resolution to the dispute.

I'm so sorry that the cats and you and Katia have had to undergo such an appalling experience.

I am so sorry, that is so terrible, it's an awful disease! I rescued a cat once and she had it and I lost her after 6 months .
This breeder needs reporting ,she is a disgrace putting it mildly and is only money orientated with total disregards and care for her cats .
I think Gill might mean the Gccf , not sure myself as not into breeding or showing .
It should be on the cats pedigrees though .

I am so very sorry, this is a terrible thing.

If she is a reputable breeder she should be registered with the breed club and also the nccf....grrrrrrrrrrr wrong initials I think...........but you should have the pedigree certificate which will have the address and the registration number of the kittens and would advise you to report her.

My wife and I recently purchased 2 kittens from a reputable breeder.28 days after purchase we had to have one kitten put to sleep as the vets opinion was he had tip.Vet further stated that it was fairly likely that kitten had fip from before we brought him.2nd kitten has now been tested and has raised raised corona virus level.Breeder advised but has not been willing to refund purchase price.Offered to replace kitten but we where advised not to have another kitten due to risk of becoming infected.Legally there seems little we can do and breeder is continuing to breed.Any suggestions as to how we might proceed.,Martin and Katia.
